New Jersey has one of the most accessible expungement frameworks in the United States. The state's expungement statute - N.J.S.A. 2C:52 - covers a broad range of offenses, and the 2020 Clean Slate Expungement Law created automatic expungement for individuals who remain crime-free for 10 years after completing their sentence. Waiting periods are relatively short: 5 years for indictable offenses (felony-equivalent) and 3 years for disorderly persons offenses (misdemeanor-equivalent). In recent years, New Jersey has also reduced waiting periods and expanded eligibility significantly. Yet despite these progressive reforms, obtaining a New Jersey expungement does not automatically address the internet problem. The njcourts.gov portal, CourtListener, Justia, and data broker sites all hold independently cached records that persist until separately addressed with documented removal requests.
